A first conviction will result in a minimum fine of $1,000 up to $5,000, possible imprisonment of up to six months or to both. There will also be a mandatory further licence suspension of six months, over and above any other suspension that may be in place.
If the suspension is as the result of certain convictions under the Criminal Code of Canada, the minimum fine is $5,000 to $25,000 together with possible imprisonment of up to six months or both and also a mandatory licence suspension of six months.
The court must be satisfied, by evidence from the prosecution, that you were aware of the suspension at the time you were stopped by the police.
The Ministry of Transportation sends out notices of suspension by regular mail and it is deemed to have received by you seven days after it was sent to the latest address on file with the Ministry.
If the suspension is for certain convictions under the Criminal Code of Canada then the notice is sent by registered mail.
It may be shown that through no fault of your own, under certain circumstances, you did not receive the notice.
