Fighting Seat Belt Related Tickets

  • Seat Belt Related Charges - What You Should Know
    Drivers charged with:

DRIVER FAILING TO ENSURE THAT A PASSENGER UNDER 16 IS WEARING A SEATBELT

on their traffic ticket may have a legitimate defence. Contact us.

Drivers are responsible for ensuring any child under 16 travelling in their vehicle is properly secured. However, the Ontario Court of Appeal recently found that a driver cannot be held liable for a child under 16 that unbuckles and/or removes the belt, having tried to make sure the child remains secure.

    Why fight the charge?

It doesn’t take much for demerit points to mount up and before very long; your licence is under suspension. Protect your licence and your insurance premiums. Speak to a licensed paralegal at POINTTS before deciding on a course of action you may regret later.

    Why POINTTS?

POINTTS’ team of Licensed Paralegals comprised of former police officers and college graduates have been trained to the highest standards and continue to have their skills and knowledge upgraded by their in-house trainer who’s responsible for ensuring all POINTTS paralegals comply with the Law Society of Upper Canada’s continuing professional development requirement.

    Why a Licensed Paralegal?

Every charge must be proven beyond a reasonable doubt by the prosecution. POINTTS Licensed Paralegals have the knowledge, skill and experience to know if that burden has been met. A person trying to represent themselves is not likely to know what has to be proven, let alone whether proven beyond a reasonable doubt. We will look at the disclosure, research the relevant case law to be used in your favor and be able to recognize technicalities that would be fatal to the prosecution’s case against you. POINTTS paralegals know how to cross-examine witnesses. When questioning police officers, we know what the answers to technical questions should be so we know if the answer given is the right one, whereas most self-represented defendants would not.

  • Traffic Ticket Questions - What Do I Do First?

How to handle your traffic ticketIf your ticket is NOT a parking ticket.

After receiving an Offense Notice (traffic violation ticket), you have three options:

    • Plead guilty by paying the fine.
    • Visit a court office to plead guilty but make submissions about the penalty (amount of fine or time to pay).
    • Request a trial. Depending on what your traffic ticket says, you may need to either mail in your traffic ticket showing that you want a trial or you may need to visit a court office to file a request for trial.

If you do not choose one of the above options within 15 days of receiving the traffic violation ticket, or if you do not appear for your trial, a Justice of the Peace will review your case and may enter a conviction without you there.

If your ticket is a parking ticket.

    You have two options:

    • Voluntarily pay the fine.
    • Challenge the ticket in court. Depending on what your ticket says, you may need to mail in your ticket or visit a location specified on the ticket, usually the local parking tags office.

  • Traffic Ticket Myths: Does a mistake on the ticket mean the case will be dropped?

    Traffic Ticket Myths: Mistakes

Not necessarily. It all depends on the nature of the mistake. The majority of mistakes can be amended by the court, either after being pointed out to the justice of the peace by the prosecutor or the person charged. The authority for amending the ticket falls under section 34 of the Provincial Offences Act.

Discuss with your POINTTS representative what you believe to be a mistake. They will be able to advise if it is fatal to the charge or amendable.

    • “I would like to take a moment to say my thanks and to acknowledge you both. I had consulted another traffic firm prior to visiting Pointts. During my visit with Sandy his knowledge, understanding and thorough questioning was clearly superior to the other ticket specialists. This gave me the confidence to employ Pointts over any other firm. In discussing my case with Michael it was very obvious that he had a plan and was very prepared to defend my position. I am very pleased with the folks at Pointts and the fact that my ticket has been withdrawn. I will gladly recommend Pointts services to anyone in need of the best professional service and ticket defense. Truly,
      Greg
    • I am writing this letter to send out my utmost appreciation in your help. You have saved me thousands of dollars in both the traffic violation itself and the long term insurance effects. I am most thankful for the opportunity you have given me to be able to continue driving which might not have been possible had my traffic ticket gone through without your assistance. I learned my lesson and will continue to drive carefully and responsibly while keeping the harmful effects of the speed at which I conducted myself in the back of my mind. To be given the freedom to drive was an independence that I took advantage of and I would like to thank you for giving me another chance.
